Mold & Water Intrusion Litigation Support

When a mold or water-intrusion dispute is heading toward a claim, a deposition, or a courtroom, the value of an inspection isn’t the finding. It’s whether the finding holds up when someone is paid to tear it apart.

We don’t remediate. That’s the entire point.

AIM does not sell remediation and does not bid the work we assess. We have no repair revenue riding on what we find.

That isn’t a marketing line — it tracks the consensus standard of care. Under ANSI/IICRC S520-2024, an assessor who is not independent of the remediator is expected to disclose in writing that they are deviating from the Standard. The 2024 edition tightened it further: a post-remediation verification only counts as a PRV when an independent third-party professional performs it. An assessor who also sells the remediation has an obvious answer to “who benefits if you find mold?” We don’t.

What we document — and what we won’t

What we document

The physical record

  • Presence, extent, and location of mold growth
  • Moisture source and intrusion pathways
  • Samples collected under chain of custody
  • Accredited laboratory analysis
  • A stated rationale for every sample — why taken, why there
  • Photo documentation, moisture mapping, thermal imaging where applicable
  • Conditions and limitations, stated plainly
What we won’t

Health causation

  • We do not offer medical or health-causation opinions. We are not physicians.
  • We will not stretch a sampling result into a diagnosis.
  • If your matter needs a causation expert, it needs a causation expert — and we would rather tell you that before you retain us than hand you an opinion that gets excluded after.

Knowing where that line sits is part of what you’re hiring.

Matters we’ve worked

Matter typeWhat we’re asked to do
Construction defectIndependent assessments of homes and buildings with water intrusion and resulting damage traced back to original construction. Documentation prepared to support claims against builders and their carriers.
Landlord–tenant disputesIndependent assessments of rental units, retained by either side. Documentation built to carry a dispute through negotiation — or through trial, if it goes that far.
HUD repair verificationIndependent verification that completed repairs meet the standard, supporting landlords’ HUD obligations.
Short-term rental clearancePre-listing and turnover verification for vacation-rental operators — documenting conditions before guests arrive, not after a complaint.

These are recurring categories of work, not a case list. We’ve handled multiple matters in each — and the specifics of every one of them stay off this page. Our clients’ matters are our clients’ business, not marketing material.

We work plaintiff-side and defense-side. Independence isn’t a posture we adopt for one party — it’s why the finding carries weight for either.

What’s in the file

A report written for a homeowner and a report written to survive cross-examination are not the same document. Ours is built for the second job:

  • Chain of custody on every sample, start to finish.
  • Accredited laboratory. Samples are analyzed by EMSL Analytical, Inc. — an independent, nationally accredited environmental testing laboratory (AIHA-LAP, LLC EMLAP accredited).
  • Documented sampling rationale. Why each sample was taken and why in that location — the reasoning is on the page, not in someone’s memory two years later.
  • Method grounded in the standard. Assessment and verification work referenced to ANSI/IICRC S520-2024.
  • Stated limitations. What the inspection covered, what it didn’t, and what the data can and cannot support.

Credentials

AIM’s assessments are run by a senior inspector — not a rotating crew of juniors — with 20+ years in industrial environmental compliance, running LDAR and EPA Method 21 programs at refineries and chemical plants. That is work where every record is written on the assumption a regulator will read it. We bring the same habit to a mold file.

Certifications held:

  • CRMI — Certified Residential Mold Inspector, Professional Mold Inspection Institute
  • CCMI — Certified Commercial Mold Inspector, Professional Mold Inspection Institute
  • CMR — Certified Mold Remediator, Professional Mold Inspection Institute — we hold the remediation credential so we know what competent remediation looks like. We don’t sell it.
  • IICRC — Registered Member, Institute of Inspection Cleaning and Restoration Certification
  • NAMRI — Registered Member, National Association of Mold Remediators and Inspectors

Certification numbers and inspector qualifications are provided on request, and appear in full in every report we issue.

Frequently asked

Do you also do the remediation?

No. We never have and we don’t bid it. We assess, document, and verify. The contractor who fixes it is someone else’s invoice, which is exactly why our finding is worth something.

Will you give an opinion on health effects?

No. We document what is physically there — presence, extent, moisture source, sampling results. Health causation is a separate expertise with a separate evidentiary bar, and it is not ours. If a matter needs that opinion, it needs a qualified causation expert.

Can you serve as an expert witness?

That depends on the matter and the scope of the opinion. Courts qualify experts opinion by opinion, not person by person — so the useful answer comes from a conversation about your specific matter. We will tell you what we can and cannot defend before you retain us, not after.

Do you work for plaintiffs or defendants?

Both. An independent assessor who only ever finds for one side isn’t independent. The finding is the finding — that’s the product.

What does litigation-support work cost?

It’s quoted per matter. Scope varies enormously between a single-unit assessment and a multi-building construction-defect claim, and we won’t pretend otherwise with a menu price. Tell us about the matter and we’ll scope it.

What lab do you use?

EMSL Analytical, Inc. — an independent, nationally accredited environmental testing laboratory (AIHA-LAP, LLC EMLAP accredited). We don’t own the lab, and the lab doesn’t own us.

Have a matter to discuss? Tell us the property, the timeline, and what’s in dispute. If we’re not the right fit, we’ll say so. Contact AIM →  ·  Commercial mold & IAQ

AIM Environmental provides independent environmental assessment, documentation, and verification. We are not attorneys and nothing on this page is legal advice. Scope, methodology, and the opinions we are able to offer are determined matter by matter. ANSI/IICRC S520 is a voluntary consensus standard; references to it describe the standard of care we work to, not a legal requirement.
